Burglary Charge reduced to attempted burglary sparing the Defendant 21 months prison

The Defendant was arrested for burglary of an unoccupied dwelling while unarmed. The Defendant and several friends were acting suspicious around a residence and when the homeowner returned home the Defendant fled from the area. Our office conducted hours of depositions with the arresting officer and the alleged victim of the crime. The initial offer from the state attorney was for our client to serve 21 months state prison, the bottom of the guidelines for a crime such as this. After many negotiation sessions, the state attorney amended the charge to attempted burglary and the Defendant received a withhold of adjudication and probation. That means once the Defendant successfully completes his probation, he will not be a convicted felon.
Aggravated Assault With A Deadly Weapon And Battery Charges Dismissed!

The Defendant was arrested for aggravated assault with a deadly weapon and battery when an unwelcomed family member showed up at his home and began an argument with him. The alleged victim stated the Defendant battered her by pushing her against the wall and out the front door. She then stated the Defendant came after her and threatened her with a machete in front of several witnesses. The Defendant was arrested and taken to jail where he was being held with a zero bond. On the same day of the arrest (Saturday) the family of the Defendant contacted AnneMarie Rizzo who quickly went to the jail and argued the Defendant's right to a bond. The Judge agreed with AnneMarie and set a bond for the Defendant. Within 45 days AnneMarie was able to gather enough evidence to convince the Prosecutor that there would be insufficient evidence to proceed with these charges and all the charges were dismissed!
ROBBERY WITH A FIREARAM FELONY PUNISHABLE BY LIFE

In Sarasota County, Florida the Sarasota County Sheriff's Office arrested the Defendant for Robbery with a firearm. The Defendant was alleged to have met with some friends to purchase oxycodone pills. As the parties were driving to pharmacies to get the prescriptions filled the victim alleged that the Defendant pulled a gun on him and his girlfriend and stole their pills. Darren Finebloom immediately began his investigation and interviewed the main witness to the case who denied there was any robbery or gun involved. This information was relayed to the Sarasota County Sheriff's Office. The Office of the State Attorney declined to file charges.
GRAND THEFT OF THIRD DEGREE

The Defendant is alleged to have entered a department store and concealed goods from the store valued at over $300. After negotiations with the State Attorney, the Defendant entered into and successully completed a program and on August 13, 2009 the State Attorney dropped all charges saving our client from being a convicted felon.
SEX OFFENSE AGAINST A CHILD 12-15 YEARS OLD (SARASOTA COUNTY)

The Defendant was accused of improperly touching a 13 year girl. At the time the warrant was issued the Defendant was in Missouri. Darren Finebloom immediately got involved and began an investigation. Darren Finebloom immediately got his client back from Missouri to turn himself in and as a result the Defendant's bond was reduced from no bond to 10,000.00. Shortly thereafter Mr. Finebloom was able to convince the State Attorney in Sarasota, Florida to decline charges in this matter.

The Defendant and his girlfriend were involved in a disagreement. According to the police report, the victim claims that the Defendant struck her in the face several times and choked her around the neck. The report does NOT mention that the next door neighbors are the ones that called the police several hours after the incident ocurred. Our client maintained his innocence and Darren Finebloom and David Haenel convinced the State Attorney that they could not prove the case beyond a reasonable doubt and declined the charges.

The Defendant was accused and arrested on one count of Child Abuse. The Defendant was alleged to have struck his child causing severe bruises. After a thorough investigation performed by Darren Finebloom it turned out it was only one bruise which occurred in the course of discipline. Florida Law allows a parent to reasonably discipline their child. After providing the case law to the State Attorney the charge was dismissed.

The Defendant was arrested for Burgalry of an Occupied Dwelling with a battery (punishable by life in prison), Felony Criminal Mischief, Resisting an Officer without Violence, and Two counts of Battery. Darren Finebloom thoroughly investigated the case and was able to show the prosecutor that there was no intent to commit a crime in the home. After lengthy negotiations the State agreed to drop all charges.

The Defendant was a 67 year old with no prior record. He was involved in a major car accident and just recovering from triple bypas surgery. A friend made advances to get him to sell her oxycodone of which the Defendant was prescribd for his pain. She eventually convinced him to sell her a trafficking amount of oxycodone and the Defendant was arrested and faced a 3yr minimum mandatory prison sentence. Darren Finebloom after lengthy negotiations with the State attorney's office was able to get the charge reduced and the Defendant was given a probationary sentence. The Defendant was facing a 3 year minimum mandatory sentence.

The Defendant was charged by the state attorney with the above mentioned charges. The Defendant was in custody in New York when we got hired on the case. After hours of work and hiring an investigator, AnneMarie Rizzo convinced the State Attorney that they had the wrong person and that our client never committed the above violations. After several months the state attorney agreed and ended up dismissing the charges.

The Defendant was approached by several officers in the city of Venice while stopped in the parking lot of a Church that was under construction. AnneMarie Rizzo actually went to the scene and took some pictures of the Church and the "alleged" construction site. She then filed a motion to dismiss with the Court claiming that the construction site was not legally posited and that the Church was not a valid construction site because there was no construction permit at the time of the offense. The State Attorney did not oppose the motion and the case was dismissed by the Judge.

The Defendant was accused of having an innapropriate relationship with one of his students. The case was all over the papers. Numerous false accusations were made and after an extensive investigation by Darren Finebloom which was provided to the State Attorney all charges were dropped.

Result: Our client was out celebrating with his brother and some friends. Our client passed out under a vehicle and fearing for his safety a bystander called 911. The paramedics arrived and gave a sternum rub to our client and a scuffle ensued with the emergency worker. The firm convinced the State Attorney not to file charges and the charge was dismissed.

After depositions of he alleged victim in this matter it was shown by Darren Finebloom that the primary motive was money. Inconsistencies in the Defendant's testimony caused the state to reduce the charge to a misdemeanor.

Result: The Defendant was charged with felony fleeing to elude. This would have resulted in a mandatory conviction making the our client a convicted felon and result in him losing his privilege to drive for a year. After an extensive investigation and deposition the Officer who was extremely honest and helpful admitted that he did not perform a felony pursuit. The case was dropped and our client pled to a misdemeanor reckless driving. No jail, no conviction and no license suspension.
