Burglary Charge Reduced To Attempted Burglary Sparing The Defendant 21 Months In Prison

The Defendant was arrested for burglary of an unoccupied dwelling while unarmed. The Defendant and several friends were acting suspicious around a residence and when the homeowner returned home the Defendant fled from the area. Our office conducted hours of depositions with the arresting officer and the alleged victim of the crime. The initial offer from the state attorney was for our client to serve 21 months in a state prison, the bottom of the guidelines for a crime such as this. After many negotiation sessions, the state attorney amended the charge to attempted burglary and the Defendant received a withhold of adjudication and probation. That means once the Defendant successfully completes his probation, he will not be a convicted felon.
